Ben & Jerry’s “Alaskan Adventure” Sweepstakes Rules

Open to Legal Residents of the United States including the District of Columbia 18 years of age and older.

HOW TO ENTER: The entry period for the Ben & Jerry’s “Alaskan Adventure” Sweepstakes (“Sweepstakes”) begins at 12:00 AM Eastern Time (ET) September 5, 2006 and ends at 11:59 PM ET October 5, 2006 (“Entry Period”). There are two (2) ways to enter this Sweepstakes: (1) To enter online: go to www.benjerry.com, click on the sweepstakes icon, complete the registration form by providing the information required AND agree to these official rules, and hit submit. Online entries must be received by 11:59 PM ET on October 5, 2006 in order to be eligible. (2) To enter via mail: print your name, address, city, state, zip, phone number and email address (optional) on a 3 1/2" x 5" piece of paper, insert in an envelope, affix postage and mail to: Ben & Jerry’s “Alaskan Adventure” Sweepstakes, P.O. Box 4320, Manhasset, NY 11030-4320. Mail-in entries must be postmarked by October 5, 2006 and received no later than October 11, 2006. There is a limit of one (1) entry per person and/or email address, regardless of method of entry, during the promotion period. Incomplete entries are void. Entries become the property of the Sponsor and will not be acknowledged or returned. Personal information collected from entrant will be used solely for the purposes of the Sweepstakes and to notify the winners and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless you otherwise agree in accordance with Sponsor’s privacy policy located at http://www.benjerry.com/our_company/privacy/.

WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries received. Drawing will be conducted on or about October 19, 2006 under the supervision of an independent judging organization whose decisions are final on matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received.

WINNER NOTIFICATION: Winners will be notified via e-mail and/or U.S. Mail within two (2) weeks of prize drawing. Winners may be required to execute and return an Affidavit of Eligibility and Liability and where legal, Publicity Release within 14 days following the date of issuance of notification. Non-compliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. Winners will also be required to furnish their social security number that will be used only for the purpose of reporting the winner’s prize earnings to the Internal Revenue Service, as required by law. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any Entries, proper names, likenesses, photographs, and/or city/states/provinces for advertising and promotional purposes in all media (including and without limitation, the Internet) without additional compensation, except where prohibited by law. If an entrant changes his/her telephone number, email address and/or street address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to Marden-Kane’s address (listed below) to be received by the end of the Entry Period.

PRIZES: One (1) Grand Prize: An REI trip for two (2) on the Alaska Denali & Prince William Sound, a one year supply of Ben & Jerry’s Ice Cream, travel books from Lonely Planet, and along with your airfare we will offset the carbon emission from you flight with NativeEnergy (go to NativeEngery.com to learn more about offsets and renewable energy. Trip includes up to $750 worth of economy airfare per person, double-occupancy accommodations in hotels and tents, 9 breakfasts, 10 lunches, 7 dinners, all van transportation, guide leadership, group cooking and camping gear including tents, entrance to the Denali National Park, shuttle bus tickets, a ferry ride from Whittier to Cordova, float-plane flight from Cordova to Valdez, a kayak tour of Shoup Glacier or a Columbia Glacier scenic cruise, a Matanuska Glacier hike, and a Nenana River rafting excursion. Approximate Retail Value of Grand Prize: $7,250. One (1) First Prize: A one year supply of Ben & Jerry’s Ice Cream and travel books from Lonely Planet. Approximate Retail Value of First Prize: $166. Total Approximate Retail Value of Prizes: $7,416. All expenses relating to acceptance and use of any prize that are not explicitly listed herein as being awarded, including payment of taxes, are responsibility of the winner. No substitution, barter, transfer, or assignment of prize permitted, except by Sponsor at its sole discretion. Sponsor reserves the right to substitute a prize of comparable or greater value if entire prize or a portion of a prize is unavailable. Prize will be awarded and winner will be notified by e-mail and/or U.S. mail. Trip must be completed by December 31, 2007 and/or on dates specified by the Sponsor. Grand Prize trip does not include airfare to Anchorage beyond the $750 value per person, 1 breakfast, 1 lunch, 4 dinners, sleeping bag and/or pad, insurance, alcoholic beverages, gratuities, optional excursions, and/or any items of personal nature. Any expenses not specifically stated herein are the sole responsibility of the winner. The winner and his/her travel companion are responsible for obtaining travel documents as well as travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledges that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. If a winner is unable to participate in or accept the prize or any portion of the prize package for any reason, the Sponsor shall have no further obligation to the winner and prize will be awarded to an alternate winner. Travel arrangements must be made through agent of Sponsor’s choosing. Actual value of the trip depends on winner’s residence or departure city. Specifics of prize package are subject to availability and Sponsor’s sole discretion. Complete terms and conditions of trip will be furnished with prize notification. Other restrictions may apply. Trip winner and travel companion must have all necessary identification and/or travel documents required for travel. Odds of winning depend on total number of entries received.
Eligibility: This Sweepstakes is open only to legal residents of the United States including the District of Columbia 18 years of age and older at the time of entry. Employees of Ben & Jerry’s, REI, Lonely Planet and its affiliates, subsidiaries, advertising and promotion agencies, including Marden-Kane Inc., prize suppliers, and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible to enter or win the Sweepstakes. Void in Puerto Rico and where prohibited by law. This Sweepstakes is subject to all applicable federal, state and local laws and regulations.

LIMITATION OF LIABILITY: BY PARTICIPATING IN THE SWEEPSTAKES, ENTRANTS AGREE TO ABIDE BY THE TERMS OF THESE OFFICIAL RULES AND THE DECISIONS OF THE SPONSOR, WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THE RULES, AND RELEASE, INDEMNIFY AND HOLD HARMLESS BEN & JERRY’S, REI, LONELY PLANET, PRIZE SUPPLIERS, MARDEN-KANE INC., AND EACH OF THEIR AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS, SHAREHOLDERS AND EMPLOYEES, (COLLECTIVELY, “RELEASEES”) FROM AND AGAINST ANY INJURIES, LOSSES, DAMAGES, CLAIMS, ACTIONS ANY LIABILITY OF ANY KIND RESULTING FROM OR ARISING FROM PARTICIPATION IN THE SWEEPSTAKES, OR ACCEPTANCE, POSSESSION, USE, MISUSE OR NONUSE OF THE PRIZE THAT MAY BE AWARDED. ENTRANTS AGREE THAT ANY AND ALL DISPUTES SHALL BE GOVERNED BY THE LAWS OF THE STATE OF VERMONT.

Additional Terms and Conditions: Releasees are not responsible for printing or typographical errors in any Sweepstakes related materials; or for transactions (including Entry submissions) that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this Sweepstakes, or process any transaction thereon. If in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Sponsor reserves the right at their sole discretion to disqualify any individual who tampers with the entry process and or void any Entries submitted fraudulently, modify or suspend the Sweepstakes, or to terminate the Sweepstakes and award the remaining prizes using all eligible, non-suspect Entries received as of the action requiring such termination. Sponsor reserves the right to modify or terminate the Sweepstakes in its entirety at any time and at its sole discretion. Should the Sweepstakes be terminated or modified prior to the stated expiration date, notice will be posted on www.benjerry.com. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with this Sweepstakes via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices, or Sweepstakes entry services or programs are prohibited.
